Disclaimer; Assumption of Risk; Waiver and Release. By entering into this Agreement, the Buyer acknowledges that there are inherent dangers, hazards, and risks associated with replacing and/or using the products offered by Mintt Global, Inc. in a hybrid or electric vehicle, as well as with all activities undertaken in connection with those products, including but not limited to Battery Cell Modules. Mintt Global, Inc. does not provide installation or other services related to the products. Therefore:

(a) Mintt Global, Inc. hereby disclaims any and all liability to the Buyer, and the Buyer fully assumes all risks of personal injury, death, or property damage arising out of or attributable to the Buyer’s use of the purchased products, including, without limitation, the Buyer’s installation, removal, handling, or modification of such products; and

(b) Buyer waives and releases any and all claims for personal injury, death, or property damage against Mintt Global, Inc., its subsidiaries, affiliates, divisions, DBAs, shareholders, officers, employees, and contractors, arising out of or attributable to the Buyer’s use of the purchased products, including, without limitation, the Buyer’s installation, removal, handling, or modification of such products.

Notwithstanding the foregoing, this waiver and release does not extend to Mintt Global, Inc.'s gross negligence, willful misconduct, or any other liabilities that New York State law does not permit to be released by agreement.

Terms and Conditions

All modules come with a 18 month or 15,000 miles warranty (whichever comes first). Warranty does not include any labor associated with installation and/or removal of parts. Buyer will not be reimbursed for any such fees—NO EXCEPTIONS. Buyer hereby acknowledges and agrees that the Seller’s liability is limited to the price of the item sold and Seller is not liable for any damage and/or injury sustained that results from any item(s) sold by any entity operated by Mintt Global, Inc. and Buyer hereby now and forever relinquishes Seller from any such liability. By entering into this Agreement, the Buyer acknowledges that there are inherent dangers, hazards, and risks associated with replacing and/or using the products offered by Mintt, Inc. in a hybrid or electric vehicle, as well as with all activities undertaken in connection with those products, including but not limited to Battery Cell Modules. Therefore: (a) Mintt Global, Inc. hereby disclaims any and all liability to the Buyer, and the Buyer fully assumes all risks of personal injury, death, or property damage arising out of or attributable to the Buyer’s use of the purchased products, including, without limitation, the Buyer’s installation, removal, handling, or modification of such products; and (b) Buyer waives and releases any and all claims for personal injury, death, or property damage against Mintt, Inc., its subsidiaries, affiliates, divisions, DBAs, shareholders, officers, employees, and contractors, arising out of or attributable to the Buyer’s use of the purchased products, including, without limitation, the Buyer’s installation, removal, handling, or modification of such products.

Returns must be in original condition and be accompanied by a Return Merchandise Authorization (RMA) otherwise the return will be deemed unauthorized. Unauthorized returns will not be processed and will be held for no more than 45 days after receipt. After 45 days, if an unauthorized return is not claimed or accompanied by an RMA, Seller reserves the right to maintain possession of the unclaimed/unauthorized return. Electrical parts are tested prior to purchase and if returned, all units will be inspected for burnt components, physical damage and water damage. Returns will be processed in the order received and may have a greater handling time than order processing. The warranty shall be void if an item is returned with any signs of: (a)burnt components; (b)physical and/or water damage; (c)misuse, abuse, modifications, opened, tampered with, and/or used for any purpose not originally intended; (d)vehicle is involved in a collision; or security seal is removed, broken and/or damaged. Buyer must activate warranty within 20 days of receipt to be valid. Returns are subject to a 20% restocking fee.

Additional Provisions which may void warranty:

• The vehicle is stored for a period of thirty (30) days or more.
• The vehicle is driven less than 5000 miles in a calendar year.
• Physical damage was caused after the delivery of the battery to the customer.
• Removal, tampering, or damage to warranty labels.
• Any modification or bypass of vehicle systems not in congruence with the manufacturer’s specifications.
• Reinstallation of the High Voltage battery into a different vehicle.
• The hybrid battery becomes damaged due to a stalling engine and/or the vehicle being driven when the engine is not operating properly. Diagnostic trouble codes that indicate this condition include but are not limited to P0A0F, P0AB9, P3190, P3191, P3193, P1196, P0101, P0102, P0505.
• Vehicle conditions that may cause premature failure.
• Water damage, fire, or other damaging incidents in which the battery’s environment is compromised.
• Discrepancies and or evidence of inaccurate mileage between Carfax, the department of motor vehicles with jurisdiction, or other sources that are considered reliable.
• Any condition beyond the control of Mintt Global, Inc.

Seller expressly reserves the right to require a Buyer to return an alleged faulty/defective unit to Seller at the Buyer’s expense for testing prior to replacement. NO replacement shall be issued until receipt of returned item. Seller will NOT reimburse any fees a Buyer expends in connection with a possible faulty/defective unit(s) including, but not limited to diagnostic fees, rental car fees, storage fees, dealership fees, third party fees, etc. Seller is not responsible for any tariffs, taxes, or import carrier fees for any country. Buyer assumes responsibility for any tariffs, taxes, and import carrier fees at time of sale. If receipt of package is refused by the Buyer, no refund will be issued. This transaction shall be deemed to have been made in the State of New York and the validity, interpretation and performance shall be governed by NY. Exclusive jurisdiction and venue over any disputes arising out of or in connection with this transaction shall be brought in Orange County, FL. After one claim, the warranty is exhausted. Buyer hereby understands, acknowledges, agrees and accepts all of the terms set forth herein upon purchase and that the terms set forth herein shall be controlling.
